You are responsible for maintaining the confidentiality of the account and password and fully responsible for all bookings and activities occurred under your account or password. You shall immediately notify Peace Tour of any unauthorized use of your account or password or any other breach of security. You are advised to change your password regularly as a precaution. c. You must provide full and accurate information (including but not limited to names, passport numbers, age gender, occupation, addresses, telephone numbers and e-mail addresses) when accessing this site and/or when making any online travel reservations. d. You are to honor your online reservations made through this site and remit to Peace Tour all charges for all services and products booked; payment terms will be by credit card. You are also liable for any surcharges, cancellation of bookings, unauthorized bookings made by yourself or on behalf of unregistered person (s). e. You must pay in full for all online reservations for any travel service or product prior to consumption. f. You agree to use this site to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You are prohibited to use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. g. You are not to copy, reproduce, republish, upload, download, store, sell, post, transmit, broadcast, circulate, distribute, display, create derivate works from or in any way exploit the content of this site without the permission of Peace Tour. You are permitted to print extracts of the materials presented on this site on a single computer for your personal, non-commercial use only. h. Unauthorised use of this site and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property, laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials. The use of such materials on any other web site or in any environment of networked computers is prohibited. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. 3. DISCLAIMER AND LIMITATIONS a. All products and/or services offered for sale and/or reservation on this site are subject to availability; acceptance, confirmation, denial, cancellation and/or postponement of such product and/or service is solely at the discretion of the product supplier. Peace Tour shall not be liable for any claims against overbooking, misinformation or mishandling of reservations by suppliers, and/or any other dissatisfaction or complaint relating to the quality of the products and/or services provided by the supplier or otherwise howsoever. In the event of mishandling, misinformation or overbooking by a supplier, or any dissatisfaction or complaint aforesaid, you should take up the matter directly with the supplier who are under an obligation to deal with such matters in accordance with Peace Tour policies. b. Peace Tour has taken all reasonable steps to ensure that this site is error free and virus free. However, Peace Tour does not warrant and cannot warrant that the use of this site will be uninterrupted, error free or virus free. c. Save for Peace Tour's willful default and gross negligence, Peace Tour shall not be liable for any injury, loss, claim, damage of any kind (including but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with any use of this site or content found herein, any failure or delay (including but not limited to the use of or inability to use any component of this site for reservations), or the performance or non-performance by Peace Tour or any third party suppliers, even if such party has been advised of the possibility of such damages, or for any other party. If, notwithstanding the foregoing, Peace Tour should be liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or use of this site or its content, the liability of Peace Tour shall in no event exceed, in aggregate, the total price of the reservation (s) with respect to which liability is found. In its sole discretion, in addition to any other rights or remedies available to Peace Tour and without any liability whatsoever, Peace Tour at any time and without notice may terminate or restrict your access to any component of this site. d. Peace Tour shall not be liable for failures or delays in performing its obligations arising from any cause beyond its control, including but not limited to acts of God, acts of civil or military authority, fires, strikes, lockouts or labour disputes, epidemics, governmental restrictions, wars, riots. Peace Tour shall not be liable for any delay in performing or failure to perform obligations if the delay or failure results from such events or circumstances outside its reasonable control. Such delay or failure shall not constitute a breach on the part of Peace Tour. 4. INDEMNITIES You shall defend and indemnify Peace Tour from and against all claims, demands, actions, proceedings, damages, liabilities, loss, expenses (including legal costs on a solicitor and client basis) which may be made against or suffered or incurred by Peace Tour arising directly or indirectly from your use of this site, whether authorized or not authorized by you, with or without your knowledge; and/or any act, omission, misconduct, negligence or any breach of any of the terms and conditions contained herein on your part. 5. LINKS This site may contain hyperlinks to web sites operated by third parties. The inclusion of hyperlinks to any such web sites does not imply Peace Tour’s endorsement of such web sites nor any association with their operators. Peace Tour is not responsible for the contents of other web sites. This Site also may contain advertisements by third parties. Unless otherwise specifically stated on this Site, we do not endorse or make any representation or warranty regarding the liability or quality or accuracy of any products or services featured in, or linked to any advertisements that appears on this Site. 6. AMENDMENTS Peace Tour shall have the right to amend these terms and conditions with or without notice at any time and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use. Such changes shall be effective upon posting of such terms on this site. 7. ADDITIONAL TERMS Additional terms and conditions may apply to reservations, purchases of travel products and services and other uses of portions of this site. By agreeing with the terms and conditions contained herein, you also agree to abide such additional terms and conditions. 8. REFUNDS AND PENALTIES In case of unexpected circumstances which may impact your holiday plans, we would be glad to assist you with the cancellation procedures and refund your money. The rates of refund are derived from our contractors' requirements, and can be summarized as follows

In our travel industry, generally a cancellation fee of 50 or up to 100% cancellation fee is applied if cancellation was made less than a specified number of days. For authentication purposes, only written cancellation notices (e-mail or fax) will be accepted. The refund will be made through bank transfer or through your credit card, depending on the original method of purchase. 9. PARTNER SHIP The relationship between Peace Tour and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other. 10. GOVERNMENT LAW a. These terms and conditions shall be governed by and construed in accordance with the laws of Vietnam . b. The parties irrevocably agree that the courts of Vietnam are to have jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions and that, accordingly, any legal action or proceedings arising out of or in connection with this Agreement may be brought in those courts and each of the parties irrevocably and unconditionally submits to the non-exclusive jurisdiction of those courts. 11. ENTIRE AGREEMENT These terms and conditions, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and super cedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this site.
